Terms of Use
1. Acceptance of these Terms
These Terms of Use govern your access to and use of the ASCA website, digital platform and related services, operated by ASCA Capital ("ASCA", "we", "us"). By accessing this website, creating an account or using any ASCA service, you acknowledge that you have read, understood and agree to be bound by these Terms of Use, together with our Privacy Policy, Disclaimer, Compliance information and any product-specific terms that may apply.
If you do not agree with these Terms, you must not use this website or any ASCA services.
2. Our services
ASCA Capital is regulated by the Monetary Authority of Singapore, and licensing details are provided in your member documentation. Where ASCA provides services through affiliated entities or branches in other jurisdictions, those services are provided by the relevant locally authorised entity under the supervision of its respective regulator.
The products, services and features described on this website may vary depending on your jurisdiction, regulatory requirements and eligibility. Certain services may not be available in all countries or to all customers and may require identity verification, additional due diligence or regulatory approval before they can be provided.
Nothing on this website constitutes an offer or solicitation where such an offer would be unlawful or require additional authorisation.
3. Eligibility and membership
Membership is offered by application or referral and is subject to acceptance by ASCA at its discretion, following successful identity verification and due diligence. You must be at least 18 years old and legally capable of entering into a binding agreement to use our services.
ASCA may decline an application, or suspend or close an account, where required by law, regulation or our internal risk and eligibility criteria.
4. Acceptable use
You agree to use ASCA's website and services lawfully, responsibly and in accordance with all applicable laws and regulations. You must not:
- use ASCA for fraudulent, illegal or unauthorised activities;
- provide false, misleading or incomplete information;
- attempt to interfere with, disrupt or compromise the security or availability of our systems;
- misuse, reverse engineer or attempt to gain unauthorised access to any part of the platform; or
- use ASCA in a manner that could harm other customers, third parties or the integrity of our services.
ASCA reserves the right to restrict, suspend or terminate access where misuse, suspected fraud, or legal or regulatory requirements make such action necessary.
5. Your account
You are responsible for maintaining the confidentiality and security of your account credentials and for all activity carried out using your account.
You must keep your contact information accurate and notify ASCA promptly if you believe your account, device or security credentials have been compromised.
ASCA will never request your password, PIN, one-time verification codes, recovery phrase, seed phrase or private cryptographic keys.
6. Fees and charges
Membership fees, service charges and any applicable transaction costs are set out in your membership tier and product documentation and may be updated from time to time in accordance with those terms.
Unless stated otherwise, fees are quoted exclusive of any taxes that may apply. We will give you advance notice of any material changes to fees where required by applicable law.
7. Intellectual property
All trademarks, logos, software, designs, graphics, text and other content made available through this website remain the property of ASCA or its licensors and are protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, publish or otherwise use any content without ASCA's prior written permission, except where permitted by applicable law.
8. Availability of services
ASCA aims to provide reliable and uninterrupted digital services. However, we do not guarantee that the website or platform will always be available without interruption, delay or technical issues.
We may suspend, modify, update or discontinue any part of our services where reasonably necessary for maintenance, security, regulatory compliance or operational purposes.
9. Limitation of liability
To the fullest extent permitted by applicable law, ASCA shall not be liable for any indirect, incidental, consequential or special loss arising from the use of this website or the services described herein.
Nothing in these Terms excludes or limits liability where such limitation would be unlawful under applicable law, including liability for death or personal injury caused by negligence or for fraud.
10. Complaints
If you are not satisfied with our services, you may submit a complaint through legal@asca.capital or the official channels set out in section 13. We will acknowledge and handle your complaint in accordance with applicable regulatory requirements.
Where a complaint is not resolved to your satisfaction, you may be entitled to refer it to the relevant external dispute resolution body or ombudsman in your jurisdiction.
11. Termination
You may close your account at any time in accordance with your product terms.
ASCA may suspend or terminate your access where required by law or regulation, in the event of misuse or suspected fraud, or where continuing the relationship would expose ASCA to unacceptable legal, regulatory or financial-crime risk.
12. Changes to these Terms
ASCA may amend these Terms of Use from time to time to reflect changes in applicable law, regulation, technology or our products and services.
The latest version will always be published on this website and will become effective upon publication unless otherwise stated. Where required by law, we will notify you of material changes in advance.
13. Governing law and contact
These Terms of Use are governed by and interpreted in accordance with the laws of Singapore, without prejudice to any mandatory consumer rights or regulatory protections applicable in your country of residence.
For any questions regarding these Terms, contact ASCA Capital at legal@asca.capital.
Miscellaneous: if any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. You may not assign your rights under these Terms without our consent.
